Kaltura Service Terms of Use

This document details the terms with which UW users must comply to use the Kaltura service.

Service Description

UW-System (UWS), and therefore UW-Green Bay (UWGB), has acquired Kaltura as a Media Management System for instructional use. The Kaltura MMS (hereafter referred to as the service) provides uploading, managing, and sharing of rich media to eligible members of the UWS academic community, in support of scholarly, curricular, and extra-curricular pursuits. The service is intended to work closely with the current Learning Management Systems while leveraging the full capability of the product.

As a user of the service, you must comply with all federal, state, local, and other applicable laws; all UWS and individual UWGB information technology and network related rules and policies, all applicable contracts and licenses; and these Terms of Use for the UWS Kaltura Media Management System. UWS reserves the right to change, at any time, at its sole discretion, the provisions of the service and these Terms of Use.


Eligibility

UWGB faculty, staff, and degree students with current and active campus-authorized credentials (e.g. NetID or equivalent) are eligible to access and use Kaltura; this excludes non-active affiliated members of the UWGB community. Prior to leaving the University community, and thereby excluded from accessing the service, users may export their content or choose to delete it.


Responsibility

Kaltura MMS content may be visible to participants within a course and others at the discretion of the content author. Uploaded content can be made private. Each piece of content is associated with an individual's campus-provided credentials. This individual, hereafter known as the 'primary author', is responsible for the content and associated data uploaded to the Kaltura MMS System.

Both individual and course content should reflect the positive and respectful learning and working environment of UWGB within which basic rules of conduct for the individual campus community, as well as the general UWGB community, prevail. Such rules of conduct are articulated in the individual campus policies and guidelines for faculty, staff and students.


Copyright

Publishing media content may involve incorporation of original works of third parties (e.g., photographs, music, film, and video works) that are covered by copyright laws. All channels and playlists in Kaltura MMS have a specified primary author who is solely responsible for detailing the sharing and permissions pertaining to copyright, fair use, and/or creative common licensing for uploaded, shared, and hosted content within each rich media item. Use of such works may be permitted by principles of fair use, consistent with copyright laws. For more information or examples of fair use, refer to your campus copyright policy for reference.

Copyright permissions are necessary regarding original Kaltura MMS content as well. Any use of UWS Kaltura content, or works derived from that content, should be attributed to the original faculty member, staff member, or student and UWGB.


FERPA

Faculty and staff should be aware that the content hosted by the Kaltura MMS identifying students, or content contributed by students, constitutes an educational record and that FERPA regulations apply. Those regulations require that the content be protected from disclosure without student consent. Disclosure in this context includes use outside of the class such as posting student content openly on the Internet. Faculty who intend to post original student work in such a manner may do so with the students’ permission or by providing an opt out option for individual students.


Monitoring

UWGB does not routinely pre-screen, monitor, or regularly review posted content and associated data, yet reserves the right to remove, at any time, at its sole discretion, any content that it considers to violate these Terms of Use or the provisions of any other campus policies that may govern use of the campus networks, or that it deems in violation of a University policy or local, state, or federal law. Should UWS or UWGB receive reports that inappropriate content has been posted, UWGB will contact the primary author to initially discuss the issue. In exceptional cases, where the content is unacceptable, UWS or UWGB will immediately remove the entry, prior to contacting the primary author. Unacceptable entries of this sort also may cause a revocation of the individual’s access to the service, and in extreme cases, may result in disciplinary proceedings against the primary author and/or contributing authors. Reports regarding inappropriate content may be sent to the campus helpdesk where the content originated.

UWS collects certain non-personally identifiable information to evaluate the manner in which Kaltura MMS is used in order to improve the service. This may include other web analysis data to measure and analyze usage. This information may be shared with UWS stakeholders in summary.


Non-Commercial Use of UWGB Kaltura MMS

UWGB Kaltura MMS provides access primarily for instructional purposes only. You may not sell, profit from, or commercialize from UWGB Kaltura MMS. UWGB considers any use of the service and its content for the purpose of deriving profit from or promoting a profit-based enterprise to be prohibited commercial use, and includes, but is not limited to, advertising to generate profit, marketing, or promoting for-profit ventures.

The media content served by the service does not in any way constitute official University of Wisconsin Green Bay content. The views and opinions expressed in the content are strictly those of the primary authors. The media content have not been reviewed or approved by UWGB. UWGB makes no representations or warranties of any kind, express or implied, as to the content hosted by this service. UWGB will not be liable for any damages of any kind arising from the use of or inability to use of the media content hosted by this service. Questions or concerns about the media content should be directed to the primary content author.


Service Availability

The service is provided as a hosted service by the vendor. Planned maintenance outage will be communicated in advance. Best efforts will be made to schedule planned downtime between 00:00 and 7:00 CST.  Unplanned outages will be posted to the UW System Outage page (https://outages.wisconsin.edu) and communicated through other support channels by individual campuses.

Campus users should contact the campus help desk as a first line of support unless otherwise directed.
